IMPORTANT DISCLOSURES

THIS DOCUMENT CONTAINS IMPORTANT INFORMATION REGARDING YOUR RIGHTS, OBLIGATIONS, CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MAY APPLY TO YOUR USE OF AGENT MONITORING LLC SERVICES.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES, WEBSITE, MOBILE APPLICATIONS, EQUIPMENT, OR COMMUNICATION SYSTEMS.

THESE TERMS REQUIRE BINDING INDIVIDUAL ARBITRATION OF DISPUTES AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS OR JURY TRIALS TO THE EXTENT PERMITTED BY LAW.

BY ENROLLING IN, ACCESSING, OR USING SERVICES PROVIDED BY AGENT MONITORING LLC (“AGENT MONITORING,” “COMPANY,” “WE,” “OUR,” OR “US”), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS AND CONDITIONS.

IF YOU ARE ENTERING THIS AGREEMENT ON BEHALF OF ANOTHER PERSON OR ENTITY, YOU REPRESENT THAT YOU HAVE AUTHORITY TO BIND THAT PERSON OR ENTITY.

USERS UNDER THE AGE OF 18 MAY NOT USE THE SERVICES WITHOUT PARENTAL, LEGAL, OR AUTHORIZED SUPERVISORY CONSENT.

1. SERVICES PROVIDED

Agent Monitoring LLC provides alcohol monitoring services, portable breath alcohol testing services, compliance monitoring services, facial recognition verification, video verification, mobile application services, location-based monitoring services, ignition interlock support services, reporting services, and related supervision technologies (collectively, the “Services”).

Services may include:

  • Portable monitoring devices

  • Mobile applications

  • Websites

  • Video and facial recognition systems

  • Reporting systems

  • Compliance notifications

  • Customer support systems

  • Monitoring dashboards

  • Device accessories and equipment

Services may be used in connection with:

  • Court orders

  • Bond conditions

  • Probation requirements

  • Pretrial supervision

  • Employer monitoring programs

  • School or organizational compliance programs

  • Voluntary accountability programs

2. MONITORING AUTHORITY DISCLOSURES

You acknowledge and agree that Agent Monitoring LLC may provide information, reports, photographs, videos, facial recognition data, compliance activity, missed tests, tampering alerts, BAC results, and related monitoring information to:

  • Courts

  • Probation departments

  • Pretrial services

  • Community supervision agencies

  • Monitoring officers

  • Attorneys when authorized

  • Government entities

  • Law enforcement agencies

  • Other authorized monitoring authorities

Agent Monitoring LLC may cooperate with lawful requests, subpoenas, warrants, investigations, or other legal processes.

3. USER RESPONSIBILITIES

You agree to:

  • Follow all program rules and instructions

  • Submit all required tests within required testing windows

  • Maintain accurate contact information

  • Maintain a compatible and operational mobile device when required

  • Keep monitoring devices charged and operational

  • Ensure reliable cellular or internet connectivity

  • Use equipment only as authorized

  • Immediately report technical issues

  • Maintain respectful communication with Company staff

  • Pay all fees and balances when due

  • Return all equipment upon request or termination

You understand that missed tests, tampering alerts, device obstruction, failed tests, refusal to test, or non-compliance activity may be reported to monitoring authorities.

4. FACIAL RECOGNITION & VIDEO CONSENT

You acknowledge and consent that:

  • Breath testing sessions may be photographed and video recorded

  • Facial recognition technology may be used for identity verification

  • Anti-tampering technology may monitor testing activity

  • Monitoring sessions may be reviewed by Company personnel and supervising authorities

Biometric identifiers and facial recognition data are collected solely for identity verification, anti-fraud, security, and compliance monitoring purposes.

Biometric data is not sold, leased, traded, or commercially disclosed.

Users are responsible for informing individuals who may appear incidentally in the background of recordings that such information may be captured.

5. ZERO ALCOHOL TOLERANCE PROGRAM

Many monitoring programs administered by Agent Monitoring LLC operate under zero alcohol tolerance requirements.

You acknowledge that:

  • Any alcohol consumption may violate program conditions

  • You are responsible for avoiding alcohol-containing substances when instructed

  • You are responsible for following retest instructions

  • Tampering or avoidance attempts may be treated as violations

Agent Monitoring LLC does not determine legal guilt or innocence and only reports monitoring activity and compliance data.

6. MOBILE APPLICATIONS & DEVICE REQUIREMENTS

Users understand that:

  • Certain Services require use of a compatible mobile device

  • Application permissions may be required for testing functionality

  • Denial of permissions may prevent successful testing

  • Older or unsupported devices may lose compatibility over time

  • Software updates may be required periodically

Agent Monitoring LLC is not responsible for failures caused by:

  • Unsupported devices

  • Jailbroken or rooted devices

  • Disabled permissions

  • Cellular outages

  • Internet failures

  • User negligence

  • Operating system incompatibility

  • Third-party platform outages

Reminder notifications are provided as a convenience feature only.

Users remain responsible for completing all required tests regardless of whether reminder notifications are received.

7. EQUIPMENT OWNERSHIP & DAMAGE

All monitoring equipment, accessories, software, and related technology remain the sole property of Agent Monitoring LLC unless otherwise stated in writing.

Users are responsible for:

  • Proper care of equipment

  • Damage caused by misuse or negligence

  • Lost or stolen equipment

  • Returning all equipment upon request

Charges may apply for:

  • Missing equipment

  • Damaged equipment

  • Unreturned accessories

  • Tampering investigations

  • Replacement costs

  • Device insurance fees

  • Administrative recovery costs

Failure to return Company property may result in collections activity and/or law enforcement referral where permitted by law.

8. PAYMENTS, FEES & COLLECTIONS

Payments are generally due in advance unless otherwise agreed in writing.

Accepted payment methods may include:

  • Credit cards

  • Debit cards

  • ACH payments

  • Approved electronic payment platforms

Users agree to pay:

  • Enrollment fees

  • Monitoring fees

  • Device fees

  • Calibration fees

  • Administrative fees

  • Lockout fees

  • Collection costs

  • Taxes where applicable

  • Replacement or damage fees

Returned payments, chargebacks, declined transactions, or delinquent balances may result in suspension, collections activity, additional fees, or reporting to monitoring authorities.

Unpaid accounts may be referred to collections agencies or attorneys.

Users may also be responsible for reasonable attorney fees and collection costs where permitted by law.

9. TERMINATION OF SERVICES

Agent Monitoring LLC may suspend or terminate Services:

  • For nonpayment

  • For violations of program rules

  • For abusive or threatening behavior

  • For suspected fraud or tampering

  • At the direction of a monitoring authority

  • For safety or operational concerns

  • For violations of these Terms

Users may request termination when permitted by program requirements.

Termination does not eliminate unpaid balances, equipment return obligations, or reporting obligations.

Unused service periods may not be prorated.

Monitoring authorities may be notified upon termination.

10. DISCLAIMERS & LIMITATION OF LIABILITY

SERVICES, EQUIPMENT, SOFTWARE, APPLICATIONS, AND TECHNOLOGY ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENT MONITORING LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.

Agent Monitoring LLC shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Lost wages

  • Bond revocations

  • Legal consequences

  • Missed appointments

  • Data interruptions

  • Cellular outages

  • Government actions

  • User negligence

  • Third-party platform failures

Users acknowledge that all monitoring systems and software may occasionally experience interruptions, delays, malfunctions, or outages.

The sole remedy for equipment malfunction shall be repair or replacement where applicable.

11. PRIVACY POLICY

Use of the Services is also governed by the Agent Monitoring LLC Privacy Policy.

By using the Services, you consent to the collection, use, disclosure, and retention of information as described in the Privacy Policy.

12. SMS TERMS OF SERVICE

By opting into SMS communications from Agent Monitoring LLC through a website form, intake form, mobile application, verbal consent, written consent, registration process, or other communication method, you consent to receive SMS text messages regarding your account and Services.

SMS communications may include:

  • Appointment reminders

  • Scheduling notifications

  • Account notifications

  • Payment reminders

  • Service alerts

  • Device-related notifications

  • Technical support communications

  • Customer service messages

  • Monitoring program updates

Sensitive compliance information, including BAC results and detailed monitoring reports, are not transmitted through standard SMS messaging.

Messaging frequency may vary.

SMS consent is not shared with third parties, affiliates, or marketing partners for promotional or marketing purposes.

13. FORCE MAJEURE

Agent Monitoring LLC shall not be responsible for delays, interruptions, or failures caused by events beyond reasonable control, including:

  • Natural disasters

  • Cellular outages

  • Internet failures

  • Government actions

  • Cybersecurity incidents

  • Power outages

  • Labor disputes

  • Platform outages

  • Emergencies

  • Supply chain interruptions

14. GOVERNING LAW

These Terms & Conditions are governed by the laws of the State of Texas without regard to conflict-of-law principles.

Venue for disputes shall be Harris County, Texas unless otherwise required by applicable law or arbitration procedures.

15. DISPUTE RESOLUTION & BINDING ARBITRATION

YOU AND AGENT MONITORING LLC AGREE TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN COURT PROCEEDINGS.

YOU WAIVE THE RIGHT TO:

  • Jury trials

  • Class actions

  • Representative proceedings

  • Consolidated claims

Arbitration shall be administered by the American Arbitration Association (“AAA”) under applicable AAA Consumer Arbitration Rules.

If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain enforceable to the fullest extent permitted by law.

16. CHANGES TO TERMS

Agent Monitoring LLC reserves the right to modify these Terms & Conditions at any time.

Updated versions become effective upon posting.

Continued use of Services constitutes acceptance of revised Terms.
